The Caller I.D. Faker Contest (the "Contest") is open to legal residents physically residing in the United States who are 18 years of age or older as of date of entry. Void wherever prohibited by law. Contest begins 12:01 AM November 1st, 2009 and ends 11:59 PM January 31st, 2010 (the "Term"). For purposes of these Official Rules, all times are [Eastern Time] [ET]
2. HOW TO ENTER:
Go to
www.calleridfaker.com and fill in the required fields in the contest banner with a valid url to see or hear the video you have made or audio you have created. Videos must be hosted on YouTube and Audio files must be a Caller ID Faker url. No purchase is necessary to enter.
3. E-MAIL CHANGE OF ADDRESS POLICY:
It is the sole responsibility of the entrant to notify Caller I.D. Faker if the entrant changes his or her e-mail address. In the event of a dispute regarding the identity of the person submitting an online entry, the entry will be deemed to be submitted by the person in whose name the e-mail account is registered. Entries by any e-mail method other than set forth in Paragraph 2 above are void. Any use of automated or programmed methods of effecting entry online is prohibited.
4. PRIZES (6 Total):
1st Place Best Video will receive a $500 American Express Gift Card. 2nd Place Best Video will receive a $250 American Express Gift Card. 1st Place Best Audio will receive a $150 American Express Gift Card. 2nd Place Best Audio will receive a $100 American Express Gift Card.
5. Winner Selection:
Winners are chosen by a mathematical formula that involves both total amount of views and average rating. Videos that have less than 500 views and Audio recordings that have less than 200 views will not be eligible.
5. CONDITIONS OF PARTICIPATION:
THE FOLLOWING TERMS CONDITIONS APPLY: Caller I.D. Faker does not assume any responsibility for incorrect or inaccurate capture of entry information, including but not limited to technical malfunctions, human or technical error, seeding or printing errors, lost/delayed/garbled data or transmissions, omission, interruption, deletion, defect or failures of: any telephone or computer line or network, computer equipment, software or any combination thereof. Entry materials/data that have been tampered with or altered are void. In the event this Contest is compromised or becomes technically corrupted in any way, electronically or otherwise, the Caller I.D. Faker reserves the right to cancel, terminate, or suspend the Contest and in such event, to select a winner by random drawing from among all valid entries received up to such time of cancellation, termination or suspension. All entries become the sole property of the Caller I.D. Faker and will not be returned. Winner will be determined in a random drawing conducted by Caller I.D. Faker whose decisions are final and binding on all matters relating to this Contest. Potential winner will be notified by e-mail on or about February 3rd and will be required to complete, sign and return, an Affidavit of Eligibility/Release of Liability and, where legal, Publicity Release. If potential winner does not reply to such notification within 10 days of the date of transmission, the notification is undeliverable after up to three attempts or the Affidavit and Release is not executed and returned to Caller I.D. Faker within 10 days of receipt, potential winner will be disqualified. All taxes on prizes and incidental expenses not mentioned herein are the responsibility of the winners, if applicable. Winner's acceptance of a prize constitutes the grant to Caller I.D. Faker to use the submitted files in any manner and claim their intellectual property rights. You will not use or attempt to use any engine, software, bot, spam, tool, agent or other device or mechanism (including without limitation browsers, spiders, or intelligent agents) to increase the votes or views to your submission. You will not attempt to violate the security of www.calleridfaker.com by any means. You agree to indemnify Caller I.D. Faker their officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, arising or resulting from your provision of any material to www.calleridfaker.com (including but not limited to claims of breach of third-party intellectual property rights) or from your breach of this agreement. Except as may arise under the immediately preceding paragraph, neither party will be liable to the other party (nor any person claiming rights derived from the other party's rights) for incidental, indirect, consequential, special, punitive or exemplary damages of any kind. You agree to only use Caller I.D. Faker's Services in ways that abide by all Local, State, and Federal laws. Using the "Recording" feature is not legal without proper consent in some of the 50 states. Please check your local laws regarding recording. Using the spoofing technology to harass, stalk, cause harm, access voicemail, is illegal. By way of example, and not as a limitation, you agree that when using Caller I.D. Faker's service, you will not: Defame abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others. Publish post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information. Any material that is deemed by Caller I.D. Faker at its sole discretion as objectionable will not be allowed and can be removed even after it has been posted to the site
6. ELIGIBILITY:
Employees of Caller I.D. Faker and their respective parents, subsidiaries, affiliates and agents, distributors, retailers, advertisers, advertising and promotion agencies and members of the immediate families of each are not eligible. All federal, state, local, provincial and municipal laws and regulations apply. Limit of one prize per person/family/household/email/ip.
7. RELEASE:
By entering, participants release Caller I.D. Faker and their respective parents, subsidiaries, affiliates and their respective directors, officers, employees, and agents from any and all liability for any injuries, losses, illnesses, litigation or damages of any kind caused by any prize, resulting from acceptance, possession, use, or misuse of any prize, or occurring while traveling to or from or participating in any prize-related activity. Entrants agree to be bound by these Official Rules and the decisions of the judges.
